If the underwater cultural relics protection zone involves two or more provinces, autonomous regions, municipalities directly under the Central Government, or other sea areas under Chinese jurisdiction outside of China’s territorial waters in accordance with Chinese law, it shall be designated and adjusted by the competent cultural relics department of the State Council, and submitted to the State Council for approval and announcement.
The delineation and adjustment of underwater cultural relics protection zones should seek the opinions of relevant departments and water use rights holders, listen to the opinions of experts and the public, and also seek the opinions of relevant military organs if it involves military management zones and military use of the sea.
Units that designate and adjust underwater cultural relics protection areas shall formulate protection plans. The competent department of cultural relics under the State Council or the competent department of cultural relics under the people’s governments of provinces, autonomous regions, and municipalities directly under the Central Government shall clearly mark the scope and boundaries of underwater cultural relics protection areas in accordance with protection plans, formulate specific protection measures, and announce their implementation.
Fishing, blasting and other activities that endanger the safety of underwater cultural relics are prohibited within the underwater cultural relics protection area.
Article 8: It is strictly prohibited to destroy, steal, loot, privately divide, hide, resell, smuggle underwater cultural relics, and other behaviors.
Those who conduct scientific investigations, resource exploration and development, tourism, diving, fishing, aquaculture, sand mining, pollution discharge, dumping and other activities in waters under Chinese jurisdiction shall comply with relevant laws and regulations and shall not endanger the safety of underwater cultural relics.
Article 9: If any unit or individual discovers underwater cultural relics suspected to be mentioned in the first and second items of the first paragraph of Article 2 of these Regulations in any way, they shall promptly report to the local or nearby cultural relics management department of the people’s government, and submit the cultural relics that have been salvaged.
After receiving the report, if there are no special circumstances, the cultural relics management department shall rush to the site within 24 hours, take immediate measures to protect it, and provide handling suggestions within 7 days; If underwater cultural relics are found to have moved or suffered actual damage, rescue protection should be carried out and detailed records should be kept; Cultural relics that have been salvaged from water should be registered and properly preserved in a timely manner.
The cultural relics management department shall protect the discovery site of underwater cultural relics, and may, if necessary, cooperate with public security organs or maritime law enforcement organs to carry out protection work, and report the protection work to the local people’s government and the cultural relics management department of the higher-level people’s government; If important cultural relics are discovered, they shall be reported to the competent department of cultural relics under the State Council step by step, and the competent department of cultural relics under the State Council shall provide handling suggestions within 15 days after receiving the report.
Article 10: If any unit or individual discovers underwater cultural relics suspected to be as stipulated in the third item of the first paragraph of Article 2 of these Regulations in any way, they shall promptly report to the nearest local people’s government cultural relics management department or directly report to the State Council cultural relics management department. The local people’s government cultural relics management department that receives the report shall report to the cultural relics management department of the State Council level by level. The State Administration of Cultural Relics.The door should promptly propose handling suggestions and report to the State Council.
Article 11: Archaeological investigation, exploration, and excavation activities of underwater cultural relics within waters under Chinese jurisdiction shall be applied to the competent cultural relics department of the State Council by units with archaeological excavation qualifications. The application materials include a work plan and an archaeological excavation qualification certificate. If the archaeological investigation, exploration, and excavation activities to be carried out are within China’s internal waters and territorial waters, opinions issued by the cultural relics department of the people’s government of the province, autonomous region, or municipality directly under the central government where the activities are located shall also be provided.
The competent department in charge of cultural relics under the State Council shall make a decision on whether to grant or not to grant permission within 30 days from the date of receiving the application materials. If permission is granted, approval documents shall be issued; If the permit is not granted, the applicant shall be notified in writing and the reasons shall be explained.
Before making a decision, the competent department in charge of cultural relics under the State Council shall seek the opinions of relevant scientific research institutions and experts, and also seek the opinions of relevant military organs in cases involving military management zones and military use of the sea; If it involves archaeological investigation, exploration, and excavation activities of underwater cultural relics in other sea areas under Chinese jurisdiction outside China’s territorial waters in accordance with Chinese law, it shall also be reported to the State Council for approval.
Article 12: Any foreign or international organization conducting underwater archaeological investigations, explorations, and excavations of cultural relics in waters under China’s jurisdiction shall cooperate with Chinese units and obtain permits. Chinese units should have archaeological excavation qualifications; The foreign unit should be a professional archaeological research institution, with experts engaged in the research direction or similar fields, and certain practical archaeological work experience.
If Sino foreign cooperation is carried out in the investigation, exploration, and excavation of underwater cultural relics, the Chinese unit shall submit an application to the competent cultural relics department of the State Council. The application materials shall include a letter of intent for cooperation between Chinese and foreign cooperative units, a work plan, and relevant materials that meet the requirements of the preceding paragraph for both parties. If the archaeological investigation, exploration, and excavation activities to be carried out are within China’s internal waters and territorial waters, opinions issued by the cultural relics department of the people’s government of the province, autonomous region, or municipality directly under the central government where the activities are located shall also be provided.
After receiving the application materials, the competent department in charge of cultural relics under the State Council shall seek the opinions of relevant scientific research institutions and experts. If it involves military management zones and military use of the sea, it shall also seek the opinions of relevant military organs and submit it to relevant departments for examination in accordance with relevant national regulations. Those who pass the review shall apply for special permission from the State Council; If the examination fails, the applicant shall be notified in writing and the reasons shall be explained.
The underwater cultural relics, natural specimens, and original archaeological records obtained from Sino foreign cooperative archaeological investigations, explorations, and excavation activities belong to China.

Article 22: Those who violate the provisions of these Regulations and engage in any of the following behaviors shall be ordered by the cultural relics regulatory department of the people’s government at or above the county level or the maritime law enforcement agency in accordance with their respective responsibilities to make corrections, recover relevant cultural relics, and be given a warning; If there are illegal gains, the illegal gains shall be confiscated. If the illegal business amount is more than 100000 yuan, a fine of 5 to 15 times the illegal business amount shall be imposed. If the illegal business amount is less than 100000 yuan, a fine of 100000 to 1 million yuan shall be imposed; If the circumstances are serious, the qualification certificate shall be revoked by the original issuing authority, and the corresponding application shall not be accepted within 10 years:
(1) Unauthorized archaeological investigation, exploration, and excavation activities of underwater cultural relics;
(2) Failure to hand over relevant physical objects or submit relevant materials in accordance with regulations after archaeological investigation, exploration, and excavation activities are completed;
(3) Conducting large-scale infrastructure projects in waters under Chinese jurisdiction without prior reporting to relevant authorities for archaeological investigation and exploration;
(4) Failure to report in a timely manner after discovering underwater cultural relics.
Article 23: These regulations shall come into effect on April 1, 2022.
