On April 24, the 2018 Promotion Meeting for Patent Law Enforcement and Rights Protection in the E-commerce Field and the Launching Ceremony of the “Thunder” Special Action were held in Hangzhou, Zhejiang Province. Zhao Meisheng, Deputy Director of the Patent Management Department of the China National Intellectual Property Administration, Yang Chunmin, Deputy Inspector of the Science and Technology Department of Zhejiang Province (Intellectual Property Office) and others attended the launch ceremony.
In his speech, Zhao Meisheng emphasized that the protection of intellectual property rights should be strictly protected, greatly protected, quickly protected, and jointly protected. “The protection of intellectual property rights should be comprehensively and strictly enforced, with the participation of governments, courts, enterprises, social institutions, and other sectors, and rapid progress should be made. All domestic and foreign enterprises, large, small, and all types of ownership should be treated equally.”.
Yang Chunmin said that Zhejiang is a province with an early and relatively rapid development of e-commerce, with the world’s largest e-commerce trading market and the largest group of e-commerce enterprises, and has bred a number of e-commerce enterprises represented by Alibaba Group. Yang Chunmin stated that Zhejiang is a major province of intellectual property rights, and the provincial intellectual property system has conscientiously implemented the innovation driven development strategy and intellectual property strategy, striving to create an ecological optimal province of intellectual property rights, continuously deepening reform in the field of intellectual property rights, strictly protecting intellectual property rights, optimizing the service environment for intellectual property rights, and making new progress in various aspects of intellectual property rights. By the end of 2017, the number of invention patents owned by 10000 people in the province had reached 19.67, and the proportion of invention patent applications to patent applications had reached 26.25%.
In order to strengthen patent law enforcement in the field of e-commerce, in February 2016, the China Electronic Commerce Patent Law Enforcement and Rights Protection Coordination and Scheduling (Zhejiang) Center (hereinafter referred to as the Zhejiang Center) was established in Zhejiang. As the first patent law enforcement and rights protection scheduling center in the e-commerce field in China, the main function of the Zhejiang Center is to establish a collaborative mechanism between provincial intellectual property law enforcement entities and e-commerce platforms in Zhejiang Province, effectively addressing the pain points of cross-border law enforcement for e-commerce patent infringement. Currently, 25 provinces (cities, autonomous regions), 10 cities, and 11 intellectual property rapid protection centers and intellectual property protection centers have joined the collaborative scheduling of patent law enforcement and protection in the e-commerce field. In 2017, the Zhejiang Center handled 114024 patent cases in the e-commerce field, involving 48337 patents.
According to reports, this “Thunder” special action will carry out joint law enforcement and case handling at the provincial, municipal, and county levels. In key areas such as e-commerce, food and drugs, environmental protection, safety production, high-tech, and key links such as exhibitions, import and export, it will organize centralized inspection and rectification actions, and accurately and quickly combat patent infringement and counterfeiting. In particular, we will increase efforts to crack down on violations and counterfeits that have a high level of public reflection and significant social impact, and we will vigorously investigate and handle typical cases to increase the momentum of the crackdown.
In order to strengthen information based means to promote law enforcement, the head of the Patent Protection Division of the Zhejiang Intellectual Property Office introduced the Zhejiang Patent Law Enforcement and Rights Protection APP, which will be officially launched on April 26.
