On the morning of April 11, the “Intellectual Property Judicial Protection Forum” was held in Hangzhou. Qiu Feizhang, Deputy Secretary of the Party Leadership Group and Deputy Director (Deputy Director) of the Provincial Department of Science and Technology (Intellectual Property Office), and Zhu Yuanyuan, Deputy Secretary of the Party Leadership Group and Vice President of the Provincial High Court attended the forum and made keynote speeches.
Qiu Feizhang affirmed the achievements of judicial and administrative protection of intellectual property in Zhejiang in recent years with vivid cases, and expounded the importance of intellectual property protection in innovation and development.
Zhejiang is a big province of intellectual property rights. In recent years, the provincial party committee and government have attached great importance to intellectual property work, issued a series of policies and measures, and achieved good results. In 2015, a total of 8584 cases of intellectual property violations were filed and investigated by the provincial intellectual property office system, with a year-on-year growth of 144.8%, accounting for 24% of the country. Among them, there were 7981 patent infringement cases, with a year-on-year growth of 169.3%, accounting for 56% of the national total, ranking the first in the country. The accumulative amount of mediation compensation is more than 2.055 million yuan.
Zhejiang’s intellectual property work has been recognized by international celebrities and the business community. On November 12 last year, when Governor Li Qiang met with the delegation of the United States Global Innovation Institute headed by Gary Locke, a Chinese politician who was the former governor of Washington State, minister of commerce, ambassador to China and other posts, Locke said to Governor Li Qiang that he was deeply impressed by the protection of Zhejiang’s intellectual property rights, which he believed was an important condition for the sustainability of Zhejiang’s innovation, entrepreneurship and economic development.
On March 30 of this year, the European Chamber of Commerce of China held the award ceremony of the “Intellectual Property Friendship Award” in Beijing. The evaluation team was composed of representatives of more than 1800 member enterprises of the European Chamber of Commerce of China and officials of the European Mission to rate the five aspects of intellectual property transparency, efficiency, cooperation, deterrence and fairness in all provinces and cities across the country. Zhejiang Province was awarded the “Intellectual Property Friendly Award” for its outstanding performance in transparency and fairness of intellectual property work. This also reflects from one side that the province has made significant progress in intellectual property protection.
Qiu Feizhang pointed out that Zhejiang’s private economy is relatively developed, and the innovation atmosphere is becoming increasingly strong. However, compared with the demand for innovative development and the voice of the people, there are still some “weaknesses”, which need us to make up for together. The next step is to further establish and improve the legal and regulatory system of intellectual property protection. In accordance with the decisions and arrangements of the central government, provincial party committees and governments, more targeted policies and measures were introduced to promote the intellectual property system as the basic guarantee for innovation. Second, efforts should be made to form a broad consensus on the protection of intellectual property rights. Establish the concept that protecting intellectual property is protecting innovation, increase the publicity of typical cases of protecting intellectual property, and create an atmosphere of respecting innovation and intellectual property in the whole society. Third, we should establish an efficient and coordinated law enforcement mechanism. We will improve the intellectual property protection model in which administrative law enforcement and judicial protection are complementary and organically linked. Comprehensively promote the “litigation mediation connection” between administrative enforcement of intellectual property civil disputes and judicial protection, including the establishment of a “third-party platform for litigation mediation connection”, and build a diversified intellectual property protection mechanism.
The event was hosted by Zhejiang Higher People’s Court, co sponsored by Zhejiang Intellectual Property Office, China Intellectual Property Law Research Association and other units, and nearly 150 people attended the forum, including experts in intellectual property law from well-known universities in China, heads of intellectual property courts at all levels, and representatives of patent agencies.
